Incredibly smart AND funny. They break these cases/suits/stories down so well for the layperson but I also love when they do a passionate deep dive on the legalities.

Miami Vice: The Hochstein Divorce

On this episode Cesie is still in trial so John and I discuss the Hochstein divorce and read some interesting excerpts from the multitude of pleadings filed in the case. We go over the prenup, Lenny's motion to kick Lisa out of their Star Island home, Lenny's motion to enforce the prenup, Lisa's requests for monetary support, the arguments over who gets to drive which Rolls Royce, Lenny's financial disclosure at the time of the prenup and in the current divorce proceedings, the restraining order Lenny's new girlfriend filed against Lisa, Lenny's motion to bifurcate the proceedings, and the somewhat murky laws about when you can and can not get into your spouse's computer or phone. John and I also provide relationship advice (that no one asked for and that your are free to ignore) and at the end of the episode, John asks me a bunch of questions (that he did not tell me about in advance) about the criminal charges against Alec Baldwin, which I attempt to answer with varying degrees of accuracy and success.

Jennifer Shah from the Real Housewives of Salt Lake City, is scheduled to be sentenced on January 6, 2023 after pleading guilty to one count of conspiracy to commit wire fraud for a telemarketing scheme that started in 2012. In this episode, we explain how the scheme began - with a predecessor entity the "Tax Club" founded by one of Jen's co-defendants, what Jen Shah's involvement was, what has happened between her arrest and now, and the sentences her co-defendants have received.

The Chrisley's Sentencing Part I

Todd and Julie Chrisley were sentenced on November 22, 2022 after a jury found them guilty of many federal criminal charges including conspiracy to commit bank fraud, bank fraud, wire fraud, and conspiracy to commit tax evasion.The sentencing involved the government and Todd and Julie submitting memorandums outlining what sentences they believed they deserved based on the crimes committed, level of responsibility taken, prior crimes, and more. We discuss how sentences are calculated and what specific arguments, with evidence, the government made in its submission. This is a great precursor to Jen Shah's sentencing as the procedure will be the same.

Bethenny Frankel recently sent TikTok creators cease and desist letters in a move she claimed was to protect her brand, but really ended up turning into a PR nightmare. But what exactly were these content creators saying and did it legally warrant such measures? At the same time, Bethenny also filed a lawsuit against TikTok claiming that the platform was financially benefitting from infringing on her right of publicity by using her voice and likeness. This lawsuit has not yet been filed, but we have seen the nearly 100-page draft complaint accusing Erika Girardi of violating the Racketeer Influenced and Corrupt Organizations Act, ("RICO"). In this episode, we explain what facts the complaint alleges to support the claim that Tom's firm was nothing more than a "family enterprise" poised to suck in victims and steal their settlement funds. We also discuss why the complaint alleges that Erika was the "frontwoman" of the whole operation and how this supports the RICO claim against her. Though Jen Shah’s trial has been moved, we still wanted to give you some insight into the case, starting with the sentencing process and the sentences some of her co-defendants have already received. As we discuss, the process includes sentencing submissions in which both sides put forth what they think the defendant should get, and the defendant puts forth evidence of their good behavior and states what led them to commit the crime. They are fascinating and help humanize the defendant. Another part of sentencing is the sentencing hearing where both sides argue about what the defendant should get based on several factors, the defendant often gives a statement, and the judge issues a sentence. We have these transcripts and read directly from them to provide you with insight. 

We hope to do a second episode on the sentences once the remaining defendants receive sentences and plan to cover each part of the trial process.

Sweet James has gone through three divorces that we cover in this episode - his divorce from his first wife, his divorce from his law firm business partner, and his recent divorce from Noella. They say, there's nothing like a woman scorned, but after reading his former business partner's complaint, we think the saying should be amended to, "there's nothing like a former partner scorned." We had to split this into two parts because there was just so much alleged. A lot is unsavory so we want to reiterate that these were allegations made in court filings.

Now that the season of Beverly Hills is over, we thought we should revisit the Girardi cases and provide an overview of what has happened since we released our last Girardi update this past June. There have been HUGE filings and allegations made within the bankruptcies that we had to share. The parallels with the Teresa and Joe fraud case cannot be more similar.

Our first was episode 4 where we talked about the basics of what it was alleged Tom did in the Edelson case.
