Incredibly smart AND funny. They break these cases/suits/stories down so well for the layperson but I also love when they do a passionate deep dive on the legalities.

Bethenny Frankel recently sent TikTok creators cease and desist letters in a move she claimed was to protect her brand, but really ended up turning into a PR nightmare. But what exactly were these content creators saying and did it legally warrant such measures? At the same time, Bethenny also filed a lawsuit against TikTok claiming that the platform was financially benefitting from infringing on her right of publicity by using her voice and likeness. We do a deep dive into that providing some other case law examples, like the recent lawsuit Cardi B won involving the same claims.

Hells Angels & "The Girardi Family Enterprise"

As you have probably heard, there is a new civil case waiting in the wings to be filed against Erika and others related to Tom Girardi's law firm. This lawsuit has not yet been filed, but we have seen the nearly 100-page draft complaint accusing Erika Girardi of violating the Racketeer Influenced and Corrupt Organizations Act, ("RICO"). In this episode, we explain what facts the complaint alleges to support the claim that Tom's firm was nothing more than a "family enterprise" poised to suck in victims and steal their settlement funds. We also discuss why the complaint alleges that Erika was the "frontwoman" of the whole operation and how this supports the RICO claim against her. The law is complex, but we explain the potential civil case accusing Erika Girardi of violating RICO, what RICO is, and provide some history of this fascinating law. Shah & Order: Sentencing

Though Jen Shah’s trial has been moved, we still wanted to give you some insight into the case, starting with the sentencing process and the sentences some of her co-defendants have already received. As we discuss, the process includes sentencing submissions in which both sides put forth what they think the defendant should get, and the defendant puts forth evidence of their good behavior and states what led them to commit the crime. They are fascinating and help humanize the defendant. Another part of sentencing is the sentencing hearing where both sides argue about what the defendant should get based on several factors, the defendant often gives a statement, and the judge issues a sentence. We have these transcripts and read directly from them to provide you with insight. 

We hope to do a second episode on the sentences once the remaining defendants receive sentences and plan to cover each part of the trial process.

This episode focuses on newest Orange County Housewife, Noella Bergener, and her husband who goes by the trademarked and highly promoted moniker of Sweet James. Sweet James has gone through three divorces that we cover in this episode - his divorce from his first wife, his divorce from his law firm business partner, and his recent divorce from Noella. They say, there's nothing like a woman scorned, but after reading his former business partner's complaint, we think the saying should be amended to, "there's nothing like a former partner scorned." We had to split this into two parts because there was just so much alleged. A lot is unsavory so we want to reiterate that these were allegations made in court filings.

We were due for a Girardi update, weren't we? Now that the season of Beverly Hills is over, we thought we should revisit the Girardi cases and provide an overview of what has happened since we released our last Girardi update this past June. There have been HUGE filings and allegations made within the bankruptcies that we had to share. The parallels with the Teresa and Joe fraud case cannot be more similar. 

Please listen to our past Girardi episodes for a refresher on the case. We have 4 episodes in total about this case. Our first was episode 4 where we talked about the basics of what it was alleged Tom did in the Edelson case. There we explained how settlement funds in contingency cases work and how what Tom was accused of doing is basic lawyer no no 101. 

Our second episode was Episode 9 where we went over Big Frank’s disbarment over doing essentially the same thing on a lesser scale. We then discussed one of the several LA times articles where they talked about how Tom’s connections got him by. 

Our third and fourth episodes about Girardi were episodes 12 and 13 where we dove DEEP into the timeline of how this came to be, discussed the various cases involved, discussed the bankruptcies and some concepts like privilege, divorces and how it could benefit Erika.
